BiteSense Terms of Service

Welcome to BiteSense (“BiteSense”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the BiteSense mobile application, website, and related services (collectively, the “Services”).

By creating an account or using the Services, you agree to these Terms. If you do not agree, please do not use BiteSense.

Important: BiteSense is not a medical device and does not provide medical advice or diagnosis. All information is for general wellness purposes only and should not replace professional medical advice, diagnosis, or treatment.


1. Eligibility and Accounts

  • To use BiteSense, you must be at least 18 years old.
  • You may only create an account using your own valid email address. Each account is tied to one email and password.
  • While multiple accounts are technically possible (for example, if using multiple emails), you are responsible for all activity under your accounts.
  • You agree to keep your account credentials secure and not share them with others.
  • You are responsible for all data logged and activity under your account.

2. Subscriptions, Payments, and Trials

2.1 Free and Premium Plans

BiteSense offers both free and paid (Premium) plans. Premium subscriptions unlock additional features such as:

  • Data-driven insights and analysis
  • AI-powered tools (where available)
  • Doctor Report exports
  • Unlimited eliminations and enhanced analytics

2.2 Billing and Free Trials

  • Premium subscriptions are billed through Apple App Store or Google Play, and managed via RevenueCat.
  • Free trials may be available for new subscribers (for example, 3-day or 7-day trials).
  • At the end of the free trial, you will be automatically charged unless you cancel before the trial ends.

2.3 Refunds

All billing and refund requests must be handled through the platform you purchased from (Apple App Store or Google Play). BiteSense does not process or issue refunds directly.

2.4 Feature Limits and Operational Costs

Premium subscriptions include access to features such as Quick Log Meal and Menu Scanner, which may have usage limits (for example, daily scan limits or meal logging limits). These limits are designed to ensure fair usage and manage operational costs.

Right to Adjust Limits: BiteSense reserves the right to adjust feature limits (including but not limited to daily usage limits for Quick Log, Menu Scanner, or other premium features) based on operational costs, service availability, or to ensure fair usage across all users. We will provide reasonable notice of any material changes to limits through in-app notifications or email.

Existing Subscribers: If you have an active subscription at the time of a limit change, we will make reasonable efforts to provide advance notice. However, we reserve the right to implement limit changes as needed to maintain service sustainability and affordability.

No Price Increases: Rather than increasing subscription prices, we may adjust feature limits to manage costs. This allows us to keep subscription prices stable while ensuring the service remains sustainable.

3. User Data and Content

3.1 Ownership

You retain ownership of all information and content you enter into the app, including meals, symptoms, eliminations, and related notes (“User Data”). By using BiteSense, you grant us a limited, worldwide, non-exclusive license to store, process, analyze, and display your User Data within the app to provide and improve the Services, including to generate derived food trait classifications. Where you have consented to AI processing, you also agree that non-identifying derived data (such as canonical food tokens and trait tags shared in our system-managed shared food trait cache, as described in our Privacy Policy) may be stored and reused to operate and improve classification for all users, without attributing those shared cache rows to you personally.

3.2 Data Export and Deletion

  • Premium users can export data (e.g., Doctor Reports) through available in-app features.
  • All users can delete their accounts at any time, which deletes associated data as outlined in our Privacy Policy.
  • Deleted accounts cannot be restored.

4. Data-Driven Insights and AI-Powered Features

  • BiteSense uses data-driven mathematical analysis to generate certain insights and summaries based on your logged data (for example, statistical correlation methods used for features such as Trigger Finder and Friendly Foods). Trait-based insights depend on foods that have been classified within the app’s lookback rules; they may be incomplete or inaccurate.
  • BiteSense also uses artificial intelligence (“AI”) for core functionality, including Food Classification, Quick Log photo analysis (where available under your plan), and Menu Scanner (powered by OpenAI; we obtain your explicit consent before sharing data—see our Privacy Policy Section 3). Acceptance of AI processing terms is required to use BiteSense when mandatory consent is enabled. AI results may be incomplete or inaccurate.
  • Shared food trait cache: With consent, classification may update a shared, system-managed cache of canonical food tokens and trait tags as described in our Privacy Policy. We do not attach your user ID to those shared cache rows. We do not run bulk automatic re-classification of your entire past meal history solely because you consented; ongoing logging applies classification going forward as described in the Privacy Policy.
  • All insights and outputs are intended for informational and wellness purposes only.
  • You agree that BiteSense is not responsible for any actions or interpretations based on insights or outputs.
  • Always use your own judgment and consult a qualified medical professional for medical decisions.

5. Health Disclaimer

BiteSense is not a medical device and does not provide medical advice, diagnosis, or treatment. All information, including data-driven insights, AI outputs, logs, and reports, is provided “as-is” for general wellness and educational purposes. You should always seek the advice of a physician or qualified healthcare provider regarding any medical condition or dietary change.

6. Acceptable Use

You agree not to:

  • Use BiteSense for any unlawful purpose or in violation of these Terms.
  • Attempt to hack, disrupt, or gain unauthorized access to any part of the Service.
  • Copy, modify, reverse engineer, or distribute our software or intellectual property.
  • Use automated tools or scraping methods to collect data.
  • Upload harmful code, spam, or content that could damage the platform or other users.

We reserve the right to suspend or terminate your account if you violate these Terms or misuse the Service.

7. Account Termination

7.1 By You

You may delete your account at any time through the in-app account settings. Once deleted, your data is removed as described in our Privacy Policy and cannot be recovered.

7.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms or applicable laws
  • Your behavior poses a risk to the platform or other users
  • You attempt to disrupt, misuse, or manipulate the Services (including AI-powered features)
  • Your subscription or billing information is invalid or fraudulent

We may also remove inactive accounts after reasonable notice.

8. Intellectual Property

All BiteSense branding, logos, content, code, design, and other intellectual property are owned by Adair Built / BiteSense and protected by copyright and trademark laws.

You may not copy, reproduce, modify, distribute, or create derivative works of the BiteSense app or website without written permission.

9. Privacy and Third-Party Data Sharing

Your privacy is important to us. Our collection and use of personal information are governed by our Privacy Policy, which forms part of these Terms.

Third-Party Services: BiteSense uses third-party services to operate the app, including Supabase (database and shared food trait cache storage), OpenAI (AI features), RevenueCat (subscriptions), PostHog (analytics), Sentry (error tracking), SendGrid (email), and Expo (app updates). Our Privacy Policy includes a complete disclosure table listing every third party, the specific data we send to each, and links to their privacy policies, including how the shared food trait cache works. By using BiteSense, you acknowledge that your data may be processed by these services as described in our Privacy Policy.

10. Service Availability

We strive to keep BiteSense available and functional but cannot guarantee uninterrupted or error-free service. Certain features, including data analysis, AI-powered tools, analytics services, or third-party integrations, may experience delays, limitations, or temporary outages.

We reserve the right to modify or discontinue features or services at any time with or without notice.

11. Limitation of Liability

To the maximum extent permitted by law:

  • BiteSense and its affiliates are not liable for any indirect, incidental, or consequential damages, including loss of data, health impacts, or revenue, arising from your use of the app.
  • BiteSense is not responsible for medical outcomes or actions taken based on data-driven insights, AI outputs, or logged information.
  • Our total liability for any claim related to the Services will not exceed the total amount paid by you (if any) in the 12 months preceding the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so these may not apply to you.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

You agree that any disputes will be brought before the courts of Ontario (Toronto), unless local law requires otherwise.

Before taking legal action, please contact us at info@bitesense.app — we will make reasonable efforts to resolve issues informally.

13. Changes to These Terms

We may update these Terms from time to time to reflect app updates, legal changes, or new features.

  • We will update the “Last Updated” date above.
  • In some cases, we may notify you through the app or by email.

Continued use of BiteSense after updates constitutes your acceptance of the new Terms.
